An awful situation that comes up more frequently than perhaps it should is the scenario where someone has started a project with a handshake agreement and then they find that things suddenly go sideways…
As an example, I once met a homeowner who was having their kitchen renovated. They had brought somebody in and discussed what they wanted, but there were no formal contracts in place.
Weeks into the project, the disagreements started. There were disputes about the payment schedule. Expectations for deadlines started to shift. And without any formal agreement, what should have been a really exciting project just became a source of constant stress.
This could all have been avoided with a well-written contract preventing these headaches. It’s clear that what you need right from the outset is professionally produced contracts that define terms and conditions, ensuring clarity for everyone.
Supply chain management in the construction world is all about ensuring that there is a reliable and efficient flow of equipment, build materials, and the services you would expect from suppliers to where the work is happening on the project site.
Imagine a complex build that was relying on a crucial delivery, and then this delivery is delayed. Or, alternatively, the materials that arrive just aren’t up to scratch. Either of these scenarios (that happen more often than you’d imagine) have the potential to throw the entire project completely off schedule and cause a load more work and often, added expense.
It’s vital to ensure that suppliers and subcontractors are on the same page, that everybody is sticking to delivery schedules and quality standards, that everyone understands clear payment terms and deadlines. This will reduce the risk of shortages or delays occurring. Having somebody on your side to resolve any supply chain issues that occur will just keep your project moving forward at a good pace.
Here’s a scary scenario: Imagine you’re halfway through a large and expensive renovation project and then a letter arrives from the council. A letter informing you that the correct planning permission has not been secured. Yep, absolute nightmare. And the worst thing is, it could easily have been avoided.
If you had ensured proper contract management, simply put, you would have been covered. Your contract manager would have made sure that you had everything lined up as far as UK regulations such as CDM 2015, any health and safety laws, and imported environmental regulations.
You need this compliance to protect you from legal disputes (which nobody needs) and to ensure that everybody is bound by the same legal obligations. A project that I read about recently featured one of those completely unexpected scenarios that caused an absolute catastrophe. Something that was totally out of anyone’s control, something that couldn’t have easily been prevented, but something that SOMEONE should have prepared for – because these things do happen.
In this case, there was a sudden storm that caused a disastrous amount of damage to a large construction site. This is the kind of situation that can utterly derail a project.
Somebody needs to be thinking about these possibilities, someone with enough industry experience and knowledge that you can completely trust them to have your back. So, risk management: Identifying any potential risks, such as storm damage or a key supplier going out of business, early on, then mitigating against them with appropriate insurance and risk-sharing arrangements.
If you have these things in place, then they act as a safety net for any eventuality, and you get to sleep soundly at night.
Changes are inevitable, but they can lead to very difficult disputes if not handled properly. This is why they’re an important part of construction contracts. We can help, making sure that the contract covers what’s been agreed so that both parties are covered.
For example, changes to costs or changes to the timelines are the kinds of things that need to be thought about. You may have reached the stage where a design has been agreed on, but a change arises. If you haven’t got a clear process, then this can easily lead to a dispute.
It’s so important to have it written down in detail. Who is going to approve the changes and if there’s any compensation that comes from the changes, then how will that work?
You need somebody who’s going to clarify this plus any additional payments or time extensions and who can outline how to proceed. It’s all about protecting everybody involved from any unfair claims when changes (naturally) occur.
This is the human part of Construction Contract Management, and it can therefore be the more difficult and unpredictable side for people or businesses to manage themselves.
Clients have often been very glad to have someone on side who can take over this area of construction project management. It’s all about leading the people in a project well, knowing who needs to be contacted when, who the primary points of contact are within the project, and when everybody’s deadlines are approaching. Setting up regular reporting to keep everybody informed and putting contingency plans in place to keep everybody on the same page.
If there’s a breach of contract or a failure to meet obligations that have been previously agreed upon, then there need to be liabilities. For example, what would you do if work carried out for you was substandard, requiring costly repairs? Or say a delivery was late, causing complete disruption to the timetable. There needs to be some kind of consequence for that, and if we can be specific about what that consequence will be, then each party is going to be in a secure position to move forward. It basically ensures accountability.
I’m talking paperwork! Does anybody else have a niggling fear of losing important documents? Or finding out that your insurance hasn’t covered you for some kind of critical event?
Luckily, I’m all over this. Properly storing important documents so they’re easily to hand, and making sure everyone involved has the correct insurance coverage that they need means that we can all just breathe a sigh of relief and get on with something more interesting.
In the unfortunate scenario where a dispute has escalated into expensive litigation, I take a proactive approach to avoid the legal remedies.
Right at the end of the project, we manage ‘project close out’, making sure that everything is packed up nice and neatly. This includes checking that final payments have been made, ensuring inspections have been carried out, overseeing handovers and double checking signoffs. We’ll scrutinise everything until we’re confident that everything has happened in the right way, and that all work has met the agreed standards.
It is only at this stage that I’d consider the project to be complete. However, the service that we offer actually goes beyond this into post-completion where we’ll be there to address warranties or maintenance agreements.
